General terms of sale

This text is a translation. In case of any discrepancy, the French version prevails.
These terms apply to every sale of a used vehicle concluded with CarsCorner Belgium, hereinafter “CarsCorner”. They are handed to the buyer before the order form is signed and form an integral part of it.

2. What this site does, and does not do
This site presents the vehicles available. It sells nothing online: it accepts no order, no payment and no firm reservation. A request for an appointment or a valuation is not an offer and reserves no vehicle; it binds neither the buyer nor CarsCorner.
The sale is concluded at the showroom, by signing an order form. It is therefore not a distance contract, and the fourteen-day right of withdrawal under article VI.47 of the Code of Economic Law does not apply.
3. Price and VAT
The prices shown are in euros, all taxes included, and include mandatory fees. The VAT regime that applies is stated on each listing:
- VAT on the margin
- The price shown is the price the buyer pays. VAT is charged on the seller’s margin and does not appear separately on the invoice, in accordance with article 58 §4 of the VAT Code. It cannot be recovered by the buyer.
- Deductible VAT
- VAT is shown separately on the invoice and can be recovered by a VAT-registered buyer, within the limits of their right to deduct.
Any promotion or discount is valid until the date stated or for as long as the vehicle concerned is available, each vehicle being unique.
4. Order, deposit and availability
The order becomes final when both parties sign the order form. A deposit may be requested; its amount is stated on the order form. If the buyer cancels after signing, CarsCorner keeps the deposit as a fixed indemnity. If CarsCorner cancels, the deposit is refunded in full within fifteen days.
Each vehicle is unique. If the vehicle ordered becomes unavailable for a reason beyond CarsCorner’s control, the sale is cancelled by operation of law and the sums paid are refunded in full, without further compensation.
5. Delivery and transfer of risk
The vehicle is handed over at the showroom unless otherwise agreed in writing. Ownership passes only on full payment of the price; risk passes on physical handover of the vehicle.
Handed over on delivery:
- the invoice;
- the Car-Pass, compulsory for every used vehicle sold in Belgium by a professional (law of 11 March 2004);
- the certificate of conformity and the registration certificate;
- the valid roadworthiness certificate, where applicable;
- the keys and any spare keys, together with the available service book.
6. Legal guarantee of conformity
Every vehicle sold to a consumer benefits from the legal guarantee of conformity under articles VI.83 and following of the Code of Economic Law, for 24 months from delivery.
The law allows this period to be shortened for second-hand goods, never below twelve months and only with the buyer’s express agreement. CarsCorner does not use this option: the guarantee is a full 24 months.
During the first 12 months, any lack of conformity that appears is presumed to have existed at the time of delivery: it is for CarsCorner to prove otherwise. After that, the burden of proof lies with the buyer.
The guarantee does not cover:
- normal wear of the vehicle and its wear parts;
- routine servicing: oil changes, filters, brake pads, tyres, wiper blades, a battery beyond its normal life;
- damage resulting from abnormal use, negligence, lack of maintenance, an accident or a modification of the vehicle;
- defects known to the buyer and recorded on the order form.
Any work on the vehicle by a third party during the guarantee period must be reported to CarsCorner. Unreported work on the faulty part may forfeit the guarantee for that defect alone.
The buyer informs CarsCorner of the defect within two months of noticing it, in writing and using the details given in point 1. The buyer is then entitled to repair or replacement; failing that, to a price reduction or to the cancellation of the sale, under the conditions laid down by law.
No clause of these terms limits the rights the consumer buyer has under the law.
7. Commercial guarantee
An additional commercial guarantee may be offered for some vehicles. It is then set out in a separate document stating its length, scope and administrator. Such a guarantee comes on top of the legal guarantee of conformity and never replaces it.
8. Part-exchange of your vehicle
A valuation given remotely relies solely on the information supplied by the owner. It is indicative and is not a commitment to buy. The part-exchange price is only firm once the vehicle has been inspected at the showroom and the price put in writing.
The seller of the part-exchanged vehicle guarantees that they own it, that the vehicle is free of any pledge or debt, and that the Car-Pass data matches its actual condition.
9. Personal data
The data you provide is processed in accordance with our privacy policy, which states the retention periods actually applied.
10. Complaints and disputes
Any complaint should first be sent to CarsCorner, using the details in point 1. We undertake to reply.
Failing an amicable solution, the consumer may contact the Consumer Mediation Service (FPS Economy, North Gate II, Boulevard du Roi Albert II 8 box 1, 1000 Brussels) or use the European online dispute resolution platform.
These terms are governed by Belgian law. The competent courts are those of the district of CarsCorner’s registered office, without prejudice to the consumer’s right to bring proceedings in the courts of their own domicile.
11. Changes
CarsCorner may change these terms. The version that applies to a sale is the one in force on the date the order form is signed, handed to the buyer at that time.
